At 6pm on March 10th, Ptl. Kyle Cranmer stopped Tom Ruiz 2nd, 44, of West Creek near the intersection of Route 72 and Route 539 for reckless driving.
During the stop, Ptl. Cranmer developed evidence that led to the search of the vehicle and the recovery of a loaded Springfield XD 9mm handgun which was located in the center console of the vehicle. Ptl. Cranmer additionally recovered a quantity of marijuana and THC oil.
Ruiz was charged with unlawful possession of a handgun, possession of hollow-point ammunition, certain persons not to have weapons, tampering with evidence, possession of CDS, and possession of drug paraphernalia. He was also issued traffic summonses for reckless driving and possession of CDS in a motor vehicle. Ruiz was lodged in the Ocean County Jail.
Members of the public and media are reminded that defendants are innocent until proven guilty in a court of law.

Everyone who owns a gun LEGALLY knows the first thing you do in the motor vehicle stop is inform the officer there is a gun in the car.
He will ask for the gun, he will inspect it and as long as it is unloaded and your permit checks out he will hand it back to you at the end of the stop.
If it’s loaded you’re getting arrested for improper possession.

Legally you do not have to tell the officer you have a weapon in the vehicle unless he ask you.
