BEACH HAVEN – A popular LBI eatery is in hot water after an investigation found that the restaurant violated federal overtime regulations, according to a statement released by the US Department of Labor’s Wage and Hour Division (WHD) on Feb. 28.
The Chicken or The Egg, commonly known as “The Chegg” in Beach Haven, is required to pay back $768,548 in back wages, liquidated damages, and penalties for violating the Fair Labor Standards Act (FLSA) and the labor provisions of the H-2B temporary visa program, stated the WHD. Operating as The Chicken or The Egg, Cramark, Inc., failed to pay employees time and a half for excess hours in a 40 hour work week.

If a huge company like six flags great adventure doesnt have to pay certain jobs OT, why should this job?
Danny Binetti because if you are a salary manager position, then you have to accept it, but let’s say you have a management title, but do the every day tasks as an employee you are entitled to an hourly rate. For example, let’s say you are a sous chef and work the daily line producing food, they can not pay you a salary of 700.00 per week and have you work 60 hours, they would have to pay you an hourly rate and time and a half for anything over 40. Employers don’t get to choose who is exempt and who is not, it’s your job responsibilities that do it for you.

I would need more information for that. Explain with proof that they do not pay overtime, because I don’t think an employer that large with tons of lawyers would be stupid enough to not pay. Chicken and egg prob pissed someone off and they went to the authorities…
They are employed seasonally and are legally considered carnies in NJ, which is not covered under the NJ overtime laws.
No idea how it’d work for Chegg, but GAdv or any amusement park in the state legally has not done anything wrong in terms of labor laws.

Maybe the investigators can get themselves over to the Manahawkin Rehab center and investigate the horrible aweful conditions some of the most dedicated kitchen employees are enduring . After all , they are taking care of your loved ones. I assure you, the owners don’t give a shit . Workers get Split pay checks ? C’mon, CHEG is seasonal , and yes they deserve to be compinsated , but were talking about healthcare cooks .
