LANOKA HARBOR – Lacey High Township School administrators are facing a civil lawsuit over injuries a student sustained from an alleged defect in the door to the student parking lot.
FIRST ON LACEY TWP. ONLINE: The lawsuit was filed this past Tuesday in Ocean County Superior Court, state court records revealed.
The plaintiff, a resident of Forked River now aged 18, is claiming that while she was a minor child attending 9th grade at LTHS in 2014, she faced injuries to her hand as a result of defects in the door the leads to the LTHS student parking lot when it slammed shut on her.
In September, 2014, the door to the student parking lot “suddenly and uncontrollably swung shut, striking the plaintiff’s hand and inuring plaintiff,” according to attorney Michael Deem, Esq of Toms River firm R.C. Shea & Associates.
“The door’s failure to close under a controlled setting may have been the result of either a missing closer, a defective closer, or a closer that was improperly calibrated/set/adjusted which amounted to a dangerous condition which was palpably unreasonable,” Deem wrote in court papers filed this week.
The student is seeking damages for injuries sustained as a result of the door.
“As the direct and proximate result of the aforesaid palpably unreasonable conduct of Defendants aforesaid, plaintiff suffered severe injuries causing permanent disability, permanent significant disfigurement, permanent loss of body function.”
The lawsuit inaccurately identified the high school’s principal as “George Brandis.” The principal’s name is Gregory Brandis, and he is listed as one of the defendants. We are not publishing the name of the plaintiff because she was a minor at the time the incident occurred.
