A Judge has imposed nearly $130,000 in fines against the owners of a gym that has repeatedly defied Gov. Phil Murphy’s executive order to remain closed during the COVID-19 pandemic.
The Atilis gym in Bellmawr, New Jersey opened its doors in May, starting a legal battle over whether Murphy’s order for nonessential businesses to remain closed was constitutional. The owners, Ian Smith and Frank Trumbetti, have said they have taken steps to ensure social distancing and taken other safety precautions.
In issuing his order Tuesday, state Superior Court Judge Robert Lougy said the gym could not “ignore orders with which it does not agree.”
The decision requires the gym and its owners to pay almost $125,000 overall for violating a court order on eight days between Aug. 1-14. and about $10,500 to the state for the legal costs of its contempt of court action.

As civil citizens we do not have the right to break laws whenever we want. $300,000 go fund me could have been used much wiser. 1) they are allowed to do personal training, 2) they could very easily get tents and bring equipment outside like many other gyms have without any issues if there true concern were there members and there health, 3) they said from day one this has nothing to do with $ and 4) use that money to fight the right way. Teach the young people the proper way to fight for there rights. Enough other people are breaking the laws….be the role model you say you are. This isn’t about liking or not liking Murphy. This sadly also isn’t about opening up safely for the members health. They already sleep there every night, obviously have nothing else to do with there time then this. Just think if all the thousands of people they could have helped during this time since $ wasn’t an issue. They could have taught alot of people things as well. However the laws also need to be fair. I don’t like that all these places are closed. I don’t like that there are bus loads of camp children dropped off at a residents house an hour at a time all day long, I don’t like that some people can have never ending funerals for one person and yet other people’s family member, parents, children had to die alone and no funerals allowed. I am not justifying Murphy’s actions by any means. I also do not find the actions of this gym to be the most responsible or effective way to handle it.

An executive order may be a general policy statement made by the Governor. The order does not have the force and effect of law. The purpose of such an order is to persuade or encourage persons, both within and without government, to accomplish the Governor’s policy set out in the order.
These laws make violations of Executive Orders a disorderly persons offense, punishable by a fine not to exceed $1,000 and/or imprisonment in the county jail for a period not to exceed six months. These penalties are left to the discretion of municipal courts, which have jurisdiction over these matters.
Meaning none of this will hold up in court.
