PROSECUTOR RELEASES LABORATORY RESULTS
IN FATAL TOMS RIVER CRASH
Ocean County Prosecutor Bradley D. Billhimer announced today that the Ocean County Medical Examiner has submitted a Toxicology Report relative to a fatal motor vehicle crash that occurred in Toms River on Sunday, November 10, 2019. The Report reveals that the driver of the vehicle, Braden DeMartin, 22, of Toms River, had a Blood Alcohol Concentration (BAC) of .189, as well as an Active THC (marijuana) level of 22 nanograms (ng) with a Metabolite THC level of 18ng. In the State of New Jersey, an individual is presumed to be under the influence of alcohol with a BAC of .08 or greater. In States where marijuana has been legalized, the per se impaired driving limit is 5ng. As a result of the Medical Examiner’s findings, it has been determined that Mr. DeMartin was significantly impaired while operating his vehicle. The passenger in the vehicle, Daniel Foley, 23, of Toms River, had a BAC of .087.
On Sunday, November 10, 2019, Toms River Township Police Units were dispatched for a report of a motor vehicle having crashed into a building on Hooper Avenue in Toms River. Investigation revealed that Mr. DeMartin was operating his 2010 Porsche Boxster at a high rate of speed northbound on Hooper Avenue when he lost control of the vehicle, struck an embankment, and was propelled airborne into the building. Mr. DeMartin and Mr. Foley were both pronounced dead at the scene.
Upon learning of the Medical Examiner’s findings, Prosecutor Billhimer offered the following comments: “This was a tragedy of unspeakable proportions, but what makes it truly heartbreaking is that it was altogether avoidable. I am releasing these findings to the public for no other reason than to educate drivers, particularly younger drivers, as to what can happen if they operate a motor vehicle while under the influence of alcohol and/or drugs. As Chief Law Enforcement Officer of Ocean County, I implore all drivers – young and not so young – to reflect upon this horrific incident, learn from it, and always be mindful of the potentially devastating consequences that may result from driving while impaired. It is incumbent upon every single motorist to make good decisions before getting behind the wheel of a car; failure to make the right choices might well produce irreversible and deadly outcomes.”
This was the incident where the Porsche went flying into the second story of the office building in Toms River in November

Pete Zito oh I watch and get disgusted actually. I do agree with that. Even when I was younger and actually went to bars more though, I either drove my friends or decided before we went out to get a taxi there and taxi back. It just isn’t worth it. Been making the smart choice since I was a kid so I don’t get the “they were kids and didn’t know better” argument. It is awful and I feel awful for the families as well but I am also great full that it was an empty building and not the second story of a house where parents or children may have been seeping. Hopefully stories like this could at least be used as lessons to our young kids (and adults as well) today. I already sent the article to my son to read.

Stephan I am so glad you brought this up, I have brought it up and not everyone is sure if the insurance company will even pay a penny for this, I mean they were driving over 100 mph, and now that they were high, the insurance company can easily throw this out, I mean if you rearended someone or got into an intersection accident then okay it was a poor decision, but in this case they instantly were an accident waiting to happen and the building as I am speaking is still not fixed 100%
I know about this as a a friend of mine kid did 360’s on the front lawn of the school on the last day of school. Lost control hit the school was arrested. The insurance company paid out zero. It was 60k in damage!
The bare minimum car insurance requirement for New Jersey drivers is: $15,000 bodily injury per person per accident. $30,000 bodily injury for all persons per accident. $5,000 property damage liability. While a car of this value would not have the bare minimum there are a bunch of drivers who do! We were told at work where we drive all day. If we were involved in a accident and were injured we could only get the max covered by both vehicle’s. If both have minimum 30k then 30k is max not combined 60k. So having higher coverage is a good thing. I raised mine to the highest possible and added a 1 millon dollar rider. The cost was around 350 dollars a year on two cars. In the above minimum 5k isn’t paying for driving off road into somebodys front lawn.
