TOMS RIVER – A two-vehicle collision caused a car to flip over and sent several to the hospital for treatment in Toms River last week, according to police.
On Dec. 12, at approximately 8:27 p.m., police responded to the intersection of Yellowbank Road and Fischer Blvd for a motor vehicle accident. Further investigation discovered that 22-year old Marta Dziak of Flushing, NY was traveling northbound on Fischer Boulevard when the accident occurred. As Dziak approached the light at Yellowbank Road, 55-year old David Clayton of Toms River made a left-hand turn in front of her, leading to the crash.
Jillian Messina of the Toms River Police Department told Jersey Shore Online that two of the five passengers in Clayton’s vehicle were assisted out by EMS and firefighters and transported to Community Medical Center for their injuries.
The preliminary investigation revealed that Dziak was driving under the influence of alcohol, said Messina. Dziak was placed under arrest and issued a Motor Vehicle Summons for Driving While Intoxicated, Reckless Driving, and An Open Bottle of Alcohol in a Motor Vehicle.
I’m a bit confused. If the 55 year old Clayton turned left into her, how is it the drunk driver’s fault. Granted, she was drunk and wrong in driving but the article says Clayton turned left in front of her making it HIS fault, no?

Even if he was in the wrong, the drunk drivers actions outweigh sorta say the fact the dui driver shouldn’t be on the road. Same with driving on a suspended license…
Melissa Michaelson I absolutely agree. She is in the wrong for being behind the wheel. With that being said, The headline however should read properly. SHE didn’t cause the crash. He did by turning left in front of her. That’s why I was confused with the headline and storyline not jiving

Beverly Reilly Ombres I think maybe he was making a left cause he had the green light and she blew through the light im thinking she had a red light. Either way she was drunk no excuse in this day and age to be driving drunk.
Perhaps if she had not been drunk her reflexes may have been better, and she may have been able to stop in time?
Maybe she was driving with no headlights on, being intoxicated, and he could not see her approaching. Could be a variety of factors.
And this is why I’m staying home during the holidays, especially the holidays…the car my sister died in, strapped in back sear with seat belt on

Driving in this area lately is chaos, I go 50 in a 50 and everyone is going 60-65 minimum especially Fischer Blvd
All cars should come factory installed blow boxes and watch how no more drunk driving happens. But they will never do it because unfortunately those fines bring in money for the state,,, sad money will overcome safety .

That intersection has been a death trap for at least 19years .
It is ALWAYS the impaired driver’s fault! End of story. You can be drunk, stopped at a red light, have a sober driver rear-end you, kill them self, and YOU WILL be charged and CONVICTED of DUI manslaughter and spend the next 10 years of your life in jail!! The laws have become INSANE and militant. There are almost an infinite number of ways to die and we commit FAR too many limited resources to trying to get the “bad guys.” That “bad guy” could be your next door neighbor that mows your lawn for free. But as soon as he has a drink and gets in a car he’s “a villain, pure concentrated evil.” And in DUI classes they continuously site studies that “show that X number of deaths” last year were alcohol “related.” What does alcohol “related” even mean? They don’t know and don’t want to know because the more ambiguous they can make the numbers, the more they can “scare” everybody into not drinking and driving. I’m obviously not condoning drinking and driving, but I am saying the laws have become militant. Why? Because there is a massive lobby out there called, yep, you guessed it, MAD. And if they could have it their way they would be able to execute you for blowing a 0.025.
So politics aside, why don’t they stop skirting the issue and instead of making people take 10 hours of DUI classes reiterating how many deaths are alcohol “related” based on this study and that study and NOT EVEN DEFINING “alcohol related” (probably because people are not stupid enough to question the validity of these studies in front of the person who will determine your fiat) just say what I said at the beginning?
“If you are over the limit and a sober driver rear-ends you while you are legitimately stopped at a red light and kills them self YOU will be charged with AND be convicted of DUI manslaughter and go to jail for the next 10 years!” That’s it! If someone had told me that 20 years ago I would have never had a single drink and driven. And unfortunately the only way I KNOW this is true is because it happened to a friend of mine about 10 years ago and he just got out of jail. His story was almost EXACTLY the same as this article. He was slightly DUI, a sober driver turned left in front of him and even though there were several witnesses who said the sober driver was completely at fault he still spent 10 years in jail. And people can talk about reflexes and this and that, but the statistics are skewed in favor of MAD and the studies are produced by college PHd candidates and approved by their committees and all they do is a simple search for “DIU” and “alcohol related.” NOT “CAUSED BY DRUNK DRIVER.” Separating out the two and actually producing REAL statistics would ruin the MAD party. Does ANYBODY know what “alcohol related” even means? What if both drivers are sober but a passenger is not and a sober driver is killed? Is that counted as “alcohol related” in a statistical analysis?
And as a side note, cigarette smoking causes about 440,000 deaths per year and you can pick up a pack at almost ANY gas station as long as you are now 21. No questions asked. And if you want to pick up 200 smokes they’ll even give you a discount!! But if someone is lighting a cigarette, isn’t paying attention to the road, you are DUI, they rear-end you and kills them self, YOU will STILL go to jail for 10 years even though THEY were the distracted driver lighting a cigarette!! Yet at MOST 10,500 people are killed by drunk drivers (assuming EVERY SINGLE “alcohol related” death is caused by the drunk driver) but we MUST devote MASSIVE amounts of resources to “getting those horrible people.” We even have county-wide awards for the officer who “snags” the most DUI’s. But the 440,000 people we just put up some commercials for but do little else other then tax them to help pay for their future medical needs (good start). So 440,000 vs 10,500!! Where are our priorities??? It is truly mad!! As in CRAZY!
