RESOLUTION AUGUST 16, 2018

WHEREAS, NJSA 40A:14-118 allows for the creation of a police department and the appointment of members as deemed appropriate, and

WHEREAS, the Governing Body recognizes the need to increase the number of regular police officers as the result of attrition, and

WHEREAS, the Civil Service Commission has certified the results of the law enforcement examination, and

WHEREAS, Harold Hester has successfully passed the Civil Service Commission examination for police officer, and has been recommended for appointment by Chief Eric S. Higgins.

NOW, THEREFORE, BE IT RESOLVED that the Mayor and Council of the Borough of Lakehurst, County of Ocean, State of New Jersey appoints Harold Hester to the position of police officer, effective August 26, 2018, at a base salary of $39,000.00 per annum, pending successful completion of pre-employment medical and psychological testing.

WHEREAS, the Borough of Lakehurst (the “Borough”), County of Ocean, duly and finally adopted the Bond Ordinances listed in Section 1;

WHEREAS, the Borough, having completed the majority of the project for the Improvements to Lake Horicon Improvements and Improvements to Other Recreation Areas authorized under the Bond Ordinance 2008-09, as amended by Ordinance 2017-05, and has a remaining funded balance of $41,737.73, Bond Ordinance 2016-05 has a remaining balance of $5,866.70, Bond Ordinance 2016-09 has a remaining balance of $1,417.68 and Ordinance 2017-06 has a remaining balance of $245.58;

WHEREAS, the Borough is desirous of reappropriating a portion of the funded balances for other capital improvements.

AN ORDINANCE OF THE BOROUGH OF LAKEHURST, COUNTY OF OCEAN, STATE OF NEW JERSEY, AMENDING CHAPTER XXV OF THE REVISED GENERAL ORDINANCES OF THE BOROUGH OF LAKEHURST, COUNTY OF OCEAN, STATE OF NEW JERSEY, ENTITLED LAND DEVELOPMENT

WHEREAS, the Borough Council of the Borough of Lakehurst (“Borough Council”), a municipal corporation in the County of Ocean, State of New Jersey, finds that the public health, safety, morals, and general welfare of the community shall be promoted by the revision and amendment of the Land Use Ordinance of the Borough to address the growing need for facilities to treat substance abuse and provide for other living arrangements for those requiring care; and

WHEREAS, the Borough Council takes note that the Legislature of the State of New Jersey has found, pursuant to N.J.S.A. 26:2B-1, that alcoholism and drug abuse are major health problems facing the residents of this State and that the full resources of New Jersey, including counties, municipalities, and residents must be mobilized in a persistent and sustained manner in order to achieve a means of addressing not only the systems of substance abuse but their root causes; and

WHEREAS, the Borough Council finds that treatment availability for substance abuse and related behavioral health issues is permitted as part of medical care in the offices of such physicians and furthermore that behavioral medical detoxification is a use allowed within such a facility which is a principal permitted use in the Highway Commercial zoning district; and

WHEREAS, New Jersey law has held that behavioral medical detoxification centers are inherently beneficial uses and that there is a statewide need for such facilities; a finding that such use heretofore had not been so designated; and

WHEREAS, the Borough Council finds that new and specialized treatments for substance abuse have been developed since the initial zoning regulation within the municipality; and

WHEREAS, the Borough Council finds that as our population ages there remains a need to provide for alternative living arrangements for our citizens; and

WHEREAS, the Borough desires to establish appropriate zoning for residential medical detoxification centers to permit such uses consistent with the New Jersey Legislature’s recognition that substance abuse treatment facilities are appropriate in some zoning districts but not others in N.J.S.A. 40:55-D-66.10; and

NOW, THEREFORE, BE IT ORDAINED, by the Borough Council of the Borough of Lakehurst that the Land Use Ordinance be hereby amended as follows:

Section 1. Definitions, as modified, shall be amended by the addition or revision of the following words and meanings:

ALTERNATIVE LIVING ARRANGEMENT: A structure in which households live in distinct rooms, yet share kitchen and plumbing facilities, central heat and common areas. Alternative living arrangement for the purpose of this chapter shall be limited to residential health-care facilities as regulated by the New Jersey Department of Health, group homes for the developmentally disabled and mentally ill as licensed and regulated by the New Jersey Department of Human Services, and congregate living arrangements. In no event shall there be living quarters below grade of a building or structure.

ASSISTED LIVING RESIDENCES:

are licensed by the Department of Health. These are

community-based facilities offering a special mix of housing, personalized support services, and

health care designed to promote maximum independence and dignity for each resident. Staff is

available 24 hours a day. These facilities promote “aging in place.” These facilities have

apartment-style housing, rooms, and congregate dining. Assisted living services providing

supervision or assistance with activities of daily living (ADLs); coordination of services by

outside health care providers; and monitoring of resident activities to help to ensure their health,

safety, and well-being, as well as the administration or supervision of medication, or personal

care services are available when needed. Apartment units offer, at a minimum, one unfurnished

room, a private bathroom, a kitchenette, and a lockable door on the unit entrance. These facilities

may also provide rooms, three meals per day, personal assistance, 24-hour staff and security,

recreation activities, and some may provide supervision of medication and limited health

services. Rooms and baths may be either private or shared. These facilities can be either private

or Medicaid providers.

BEHAVIORAL HEALTH CARE FACILITY: A building or portion of a building whether private for-profit or non-profit, or institutional, principally engaged in providing inpatient and/or outpatient services for the treatment of victims of addiction, psychiatric, psychological, or other behavioral health condition where such services may be provided on a short term or long term basis, and whose operators are licensed to provide such services by the State of New Jersey. Such facilities may include laundries, cafeterias for employees and patients, and laboratories, 24-hour staff and security provided they are ancillary to the use.

CONTINUING-CARE RETIREMENT COMMUNITIES: are regulated by the New Jersey department of Community Affairs.

HEALTH CARE FACILITY: A building or portion of a building such as a hospital, whether private or an institution, principally engaged in providing inpatient and outpatient services for physical health maintenance, diagnosis (including testing) and treatment of human diseases, pain or other physical condition of patients; acute care facility; rehabilitation hospital; ambulatory surgical center. Care may be provided on a short term or long term basis. Outpatient services

These provide housing, services, and health care, including

nursing home care, to people of retirement age as defined by the New Jersey Department of

Community Affairs. The community must provide a continuum of care to meet the needs of

individual residents, beginning with independent living through skilled nursing care. Continuing-

care retirement communities offer a contract that is signed when the person first enters the

community. The contract will define the type of housing and services to be provided. Meals,

housekeeping, linens, 24-hour staff and security, and recreational services are usually provided.

may also be provided as a secondary service. Such facilities may include laundries, cafeterias, gift shops, laboratories, 24-hour staff and security, and medical offices as accessory uses.

MEDICAL CLINIC: A public health facility, blood donor center, kidney dialysis center, or walk-in medical office not requiring prior appointment.

OFFICE, MEDICAL: A building or portion of a building principally engaged in providing services for health maintenance, diagnosis (including testing) and treatment of human diseases, pain or other physical or mental condition of patients solely on an outpatient basis, but not to include a behavioral health care center or residential medical detoxification facility. No overnight patients shall be kept on the premises. Examples of medical offices shall include but not be limited to general physicians, dentists, chiropractors, psychologists, cardiologists, and other various specialties.

OFFICE, RESEARCH AND DEVELOPMENT: A building or portion of a building principally engaged in developing new products or procedures, or to improvement of existing products or procedures. Research and development offices may include laboratory space, pilot manufacturing, and production space and/or office space.

URGENT CARE CENTER: A type of medical clinic in a building or portion of a building, whether private or institution, principally engaged in providing walk-in, extended-hour access for acute illness and injury care that is beyond the scope or availability of the typical primary care practice or other medical clinic. Patients shall be served solely on an outpatient basis and such services shall not include overnight stays.

Section 2. Highway Commercial District shall be amended by adding conditional uses for assisted living residences, continuing care retirement communities, residential medical detoxification center, behavioral health care facility, and other revisions as follows:

A. Accessory Uses Permitted: Any of the following accessory uses may be permitted when used in conjunction with a principal use:

1. Off-street parking.

2. Fences and walls.

3. Signs.

4. Garages, storage buildings, and tool sheds.

5. Restaurant or employee cafeterias as part of a principal building or as the entire use of

an accessory building, provided the cafeteria is limited in service to the employees of the principal use designated on the site plan as approved by the Board. Satellite dish and television antennae.

6. Accessory uses customarily incidental to a principal use.

B. Conditional Uses Permitted: The following use may be permitted when authorized as a conditional use by the Land Use Board:

1. assisted living residences, continuing care retirement communities, behavioral health care facility, health care facility, conforming to the following conditions:

a. Such use shall be located west of Center Street and front on State Highway 70.

b. The minimum lot area shall be 2 acres.

c. The maximum number of patients at the location of the facility shall not

exceed 50 in-patient persons.

d. The use shall not be combined with a single-family, detached manufacturing

or industrial use.

C. Area, Yard, Height, and Building Coverage. Except as otherwise modified, the following

bulk standards shall apply to all lots:

1. assisted living residences, continuing care retirement communities, behavioral health care facility, health care facility.

Section 3. Continuation. In all other respects, the Land Use Ordinance of the Borough of Lakehurst shall remain unchanged.

Section 4. Severability. If any portion of this Ordinance is for any reason held to be unconstitutional or invalid by a court of competent jurisdiction, such decision shall not affect the validity of the Land Use Ordinance as a whole, or any other part thereof.

Section 5. Repealer. All ordinances or parts of ordinances which are inconsistent with the provisions of this Ordinance are hereby repealed to the extent of such inconsistency only.

Section 6. Enactment. This Ordinance shall take effect upon the filing thereof with the Ocean County Planning Board after final passage, adoption, and publication by the Borough Clerk of the Borough of Lakehurst in the manner prescribed by law.

SEVERABILITY

Each section, subsection, sentence, clause and phrase of this Ordinance is declared to be an independent section, subsection, sentence, clause and phrase, and the finding or holding of any such portion of this Ordinance to be unconstitutional, void, or ineffective for any cause, or reason, shall not affect any other portion of this Ordinance.

EFFECTIVE DATE

This Ordinance shall take effect immediately upon final passage and publication as required by law.

NOTICE IS HEREBY GIVEN that the foregoing ordinance was introduced and passed on first reading at the regular meeting of the governing body of the Borough of Lakehurst, County of Ocean, and State of New Jersey, held on the sixteenth day of August, 2018 and that said ordinance will be considered for final passage at the meeting of said governing body to be held at the Community Center, Center Street, Lakehurst, New Jersey on the sixth day of September, 2018 at 7:30 p.m. or as soon thereafter as said matter may be reached, at which time and place any person desiring to be heard shall be given an opportunity to be so heard.

“Lakehurst town council wants to amend chapter XXV of the revised general ordinances. Thus allowing land to be allocated for an inpatient/outpatient clinic for people with substance abuse problems. From what the amendment indicates it looks like they are looking to use the land where La Bove Grande resides. This action would bring an influx of non resident patients to our town. We are a small town and cannot accommodate such an endeavor. This will most likely raise our already rising crime rate. Home values will decrease and insurance premiums will increase. Our already high property taxes will increase due to demand for more police presence and administrative costs. If you agree that this amendment should be blocked  please sign the petition and share it. Let’s show the council that we the people of Lakehurst will not stand by while they put monetary gains over the safety of our community.”
